Attorney General Jeff Sessions Rescinds Obama-Era Immigration Guidelines

The administration issued a similar guidance document in 2016 aimed at giving schools a framework for "considering race to further the compelling interests in achieving diversity and avoiding racial isolation".

The admissions memos were among 24 policy documents rescinded by Attorney General Jeff Sessions Tuesday for being "unnecessary, outdated, inconsistent with existing law, or otherwise improper", in what Sessions said was a return to "the rule of law".

Administration officials didn't immediately respond to the paper's requests for comment. "That's wrong, and it's not good government".

The Justice Department under Republican President Donald Trump has been investigating a complaint by more than 60 Asian-American organizations that say Harvard University's policies are discriminatory because they limit the acceptance of Asian-Americans.

Not all colleges use race in admissions.

Democrats pounced, noting that the rescissions come roughly a week before Trump is expected to announce his pick to succeed Supreme Court Justice Anthony Kennedy, who is slated to step down on July 31. Colleges could potentially use the new Trump revisions to help defend themselves against lawsuits over their admission policies, however.

The federal government's policy now reverts to what it was during the George W. Bush administration, which said schools should not consider race in admissions unless it was essential to achieving their educational missions.

And, finally, the court has said that it has to show that there are no race-neutral alternatives available. "The message - but not the law - could be that if you take race into account or ethnicity into account as one of the several factors in your review process, you're going to be challenged", he said.

The administration revived the probe past year after Obama civil rights officials. The Director of Higher Learning in Colorado - Dan Baer - said much of Colorado's rules would remain in place at public universities.

The Cato Institute's Shapiro maintained that there are other ways besides affirmative action to create a more diverse student body. Justice Antonin Scalia died after the court heard arguments in the case but before the decision was handed down.

Revoking the Obama-era guidance on affirmative action could affect elementary and secondary schools that have grappled with racial imbalances. In a statement, the school called the lawsuit an attack on its ability to consider race in admissions, which it says is necessary to assemble a diverse mix of students.

The policy, enacted by President Barack Obama's Justice and Education departments in 2011 and 2016, focused on providing legal guidance to colleges that wanted to include race as a factor in the admission process.
