How a Terror Case Could Help Trump's Attorney-Client Privilege Argument

Attorney Joanna Hendon made the request in a letter submitted late Sunday to federal Judge Kimba Wood in a Manhattan court.

A legal fight over what should happen to records the Federal Bureau of Investigation seized from U.S. President Donald Trump's personal attorney took a surprise twist Monday when the lawyer, Michael Cohen, was forced to reveal in court that he had also secretly done legal work for Fox News host Sean Hannity.

The judge will weigh that argument during a hearing Monday.

The Department of Justice announced Friday that Cohen had been "under criminal investigation" for months in NY relating to his business dealings.

Todd Harrison, a lawyer for Cohen, said at Friday's hearing that "thousands" of documents seized were likely privileged, and that many related to clients other than Trump.

Cohen's attorneys want prosecutors ordered to temporarily halt an examination of the seized material, saying it's protected by attorney-client privilege.

The justice department has "reason to believe that Cohen has exceedingly few clients and a low volume of potentially privileged communications", McKay wrote. But the raid reportedly unsettled Trump enough that he had a phone call with Cohen on Friday to "check in". Court documents show that Mr. Cohen was actually under investigation for months by the US attorney in NY, according to the report.

Also in the courtroom: A pornographic video actress who claims to have had an affair with Trump, and who is trying to void the terms of a $130,000 hush-money settlement she reached with Trump's lawyer just before the 2016 presidential election.

So Cohen could provide the court with an expansive list of everyone he assisted and claim they were his clients.

"Last Monday both Mr. Cohen and President Trump made inflammatory comments about this case".

Though President Trump declared after last week's raids that "attorney-client privilege is dead", there's actually a higher bar for obtaining a search warrant that might scoop up privileged materials.

Prosecutors have asked that the seized documents be reviewed for attorney-client privilege by a "filter team" of lawyers within their own office, who would be walled off from the main prosecution team.

At issue is exactly who gets to look at Cohen's seized documents and devices before they are turned over to prosecutors. Outside afterward, she said Cohen has acted like he's above the law and that she and her lawyer are committed to making sure everyone learns the truth. Mueller's team recently told Trump's lawyers that he is a subject of the investigation, but not a criminal target.

Prosecutors with the United States attorney's office in Manhattan said they have a "filter team" of lawyers separate from those involved in the investigation in place to review the documents for any communications between Cohen and his clients. "I have may lawyers and they are probably wondering when their offices and even homes, are going to be raided". Cohen's lawyer is asking for the lawyers themselves to review the material or a "special master" to decide what is relevant to the case, and Hendon is concerned about a taint team or however the material is handled.
