INX Media case: Karti Chidmabaram sent to judicial custody for 12 days

He was arrested in February for allegedly taking money to facilitate Foreign Investment Promotion Board (FIPB) clearance to INX Media in 2007 when his father was the Finance Minister in the UPA Government. Karti's plea was that since his father dealt with various stringent penal laws like TADA, MCOCA, UAPA (Unlawful Activities Prevention Act) and NDPS (Narcotics Drugs and Psychotropic Substances) Acts and many of these prisoners are facing prosecution under the same laws, he may face a threat from them. The special CBI court acknowledged that the accused is a son of a former union minister, however it said that his "social status" can not be the basis of providing him any special facility like a separate jail.

Jail authorities should ensure proper security and safety as per rules, he said.

While admitting that the apprehension raised cannot be ignored keeping in view the social status of the accused and his family, the judge said, "only keeping in view the fact of social status of the accused and his father, he cannot be treated different from other accused persons and cannot be allowed to be kept in separate prison". Today, the investigative agency asked for judicial custody of 15 days, claiming that Karti isn't cooperating during questioning, reported ANI.

"During the entire period of police custody remand, Karti Chidambaram was evasive and non-cooperative".

Stressed on Karti Chidambaram's visits, he said that if the accused did not face any threat then, how did he now fear it in the jail, where there is deployment of large number of security personnel.

The counsel had sought a separate cell for Karti Chidambaram while citing possible threats from "terrorists" lodged at Tihar jail during P Chidambaram's stint as home minister.

The CBI Judge, after hearing the parties, observed that no separate prison shall be provided to Karti.

It is noteworthy that Karti's lawyer Abhishek Manu Singhvi, asking for an extension of the remand, said that the CBI comes with some excuse for remand every time.

The Court agreed to Karti's demand for medicines and spectacle but rejected his demand to provide him with home cook food.

Karti Chidambaram is being interrogated by the CBI since his February 28 arrest.

Meanwhile, Karti's CA, S Bhaskararaman, has moved the court for anticipatory bail in the same case.

The CBI initially alleged that Karti received Rs 10 lakh as bribe for the FIPB clearance. It, however, later revised the figure to United States dollars 1 million (about Rs 6.50 crore at the current exchange rate and Rs 4.50 crore in 2007).
