Ex-policeman faces 20 years in prison for Scott slaying

U.S. District Judge David Norton ruled today that Michael Slager committed second-degree murder and obstruction of justice, according to a report from ABC News.

The judge said he will announce his decision later Thursday but will sentence the former officer to a minimum of 235 months, or almost 20 years, in prison.

Retired North Charleston officer Wade Humphries, a former indirect supervisor of Michael Slager, called Slager his "go-to" man in the department and said that Slager was following his training when shooting at the suspect "until the threat cease [d]".

Slager, a former North Charleston cop, shot and killed Scott on April 4, 2015. The two scuffled and Slager opened fire as Scott was running away, hitting him five times in the back. He broke down the cell phone video frame by frame and explained that he could see that there was a fight between Scott and Slager, when they were on the ground.

Members of the Scott family filled one side of the courtroom Monday. However, Norton gave greater weight to prosecution evidence showing Slager had lied about crucial facts and tried to cover up aspects of the shooting so Scott appeared at fault. Federal guidelines recommend a sentence of between 19 and 24 years for that offense. He said he shot the 50-year-old Black motorist in self-defense after Scott tried to grab his Taser.

During his state trial previous year, Slager testified that he feared for his life when Scott grabbed for his weapon and charged at him.

The incident, which ended in Scott's killing, was captured on cellphone video by a nearby onlooker. As part of the plea agreement reached in May, prosecutors dropped state murder charges. (In a presentencing memo, Slager's lawyers even cited Jeff Sessions' memory lapses while under oath to justify discrepancies in Slager's accounts.) Prosecutors, meanwhile, argued that Slager's choice to shoot a fleeing man showed malicious intent and warranted a punishment of life in prison.

While that case was ongoing, federal authorities pursued a parallel investigation against Slager on civil rights charges. "It took me a long time". State prosecutors were set to retry him earlier this year, but as part of a plea agreement, Slager pleaded guilty to a federal civil rights violation for using excessive force and SC agreed to drop the murder charge.
